NEW DELHI: The bill criminalising Triple Talaq across the country has become an Act, or law with Constitutional sanction. President Ram Nath Kovind gave his assent to the bill passed by Parliament, a government notification on Wednesday said. Some 20 nations across the world, including some Islamic nations, do not approve of the Triple Talaq system of divorce. The Supreme Court of India too had ruled against it. However, this is the first time that this has been made a criminal offence in India.
This makes the instant divorce system practised by husbands in Muslim community a criminal offence from now on, and those indulging in this practice would be made to serve a three-year jail term and a fine of Rs 10,000. The Muslim Women Protection of Rights on Marriage Act 2019 replaced an ordinance promulgated on February 21, and the bill passed in both houses of Parliament this year.
The legislation is seen as one of the major social reformatory steps of Prime Minister Narendra Modi and the ruling BJP which leads the National Democratic Front government at the Centre. Some prominent political outfits of Muslims are opposed to the new legislation and see this as an interference into aspects relating to their religious faith. These parties include the AIIM of Assaduddin Owaisi based out of Telangana and the Muslim League in Kerala.
The bill dragged for a while in Parliament as the BJP-NDA struggled hard to gain majority support for the bill in Rajya Sabha, where it remained a minority all through its last term. –IHN-NN
